Terms of use
These terms govern the use of the PulseTime application, published by H&H Informatique SA, Rue Léon Morel 4, 5032 Isnes (Belgium). By subscribing to a plan or using the service, the Client unreservedly accepts these terms.
The commercial aspect (plans, payment, billing, refunds, warranties, liability, termination) is dealt with in a separate document: the Terms of sale. Both documents apply jointly.
1. Definitions
- Service / Solution: the PulseTime application accessible via pulsetime.be and its subdomains, including the marketing site, the web application (administrator and team member), the mobile application (Expo / React Native) and the related API.
- Editor: H&H Informatique SA.
- Client: the legal entity (company, non-profit, self-employed) that subscribes to a plan and appoints a Primary Administrator.
- Primary Administrator: the natural person representing the Client, account holder and responsible for billing.
- User: any person accessing the Service (administrator, secondary administrator, team member).
2. Purpose and access
The Editor provides the Client with a SaaS (Software as a Service) solution for working-time registration compliant with the applicable Belgian law. The Service is accessible via a web browser or via the mobile application installable on smartphone and tablet.
Access is secured by personal credentials (access link containing a unique token, or email and password). The Primary Administrator is responsible for creating User accounts and for the confidentiality of their own credentials.
3. Free trial
When creating a new company, the Client benefits from a 15-day free trial with unlimited access to the features. No credit card is required to open the trial.
At the end of the trial, if the Client has not subscribed to a paid plan, the productive features are suspended (no new entries or invitations of team members). The Client retains read access to their existing data (team members, entries, reports) so they can export it or subscribe to a plan at any time.
After 30 days without subscription from the end of the trial, account access is locked: no new sign-in is possible. To reactivate the account and recover the data, the Client can contact us at info@pulsetime.be. Data is kept for the time required to handle the request, except for longer legal obligations (Belgian working-time register, see privacy policy).
4. Client obligations
The Client undertakes to:
- use the Service in line with its purpose and the applicable laws and regulations (in particular Belgian labour law and data protection);
- not attempt to bypass security measures, not carry out intrusion tests without written agreement, not use the Service for illegal purposes or to store prohibited content;
- provide accurate information when signing up and keep it up to date;
- keep credentials confidential and inform the Editor immediately in case of compromise;
- obtain and document the consent or prior information of their team members for the implementation of an electronic time-tracking system, in line with the data protection law and the applicable collective agreement.
5. Intellectual property
The Service, the PulseTime brand, source code, visual identity and all its content are the exclusive property of the Editor. The subscription grants the Client a personal, non-exclusive, non-assignable and non-transferable right of use for the duration of the subscription. No transfer of rights is granted.
Conversely, the data entered by the Client and its Users (entries, locations, identities, etc.) remain the property of the Client. The Editor uses it strictly within the scope of the Service and the applicable data processing agreement.
6. Personal data
The processing of personal data is governed by our privacy policy and by the data processing agreement (DPA), accepted with the paid subscription and provided on request at dpo@pulsetime.be.
7. Availability and maintenance
The Editor undertakes to use reasonable means to ensure high availability of the Service. However, the Service may be subject to planned interruptions (updates, maintenance) or unplanned interruptions (incident, force majeure). Planned interruptions are announced in advance where possible.
The applicable service level and the consequences of unavailability are set out in the Terms of sale.
8. Changes to these terms
The Editor may amend these terms to reflect a change in the law or in the Service. The new version is notified to the Primary Administrator and enters into force 30 days later. If the Client does not accept the changes, they may terminate without penalty before the effective date.
9. Governing law and jurisdiction
These terms are governed by Belgian law. Any dispute relating to their interpretation or performance shall, failing an amicable settlement, be subject to the exclusive jurisdiction of the courts of the district of Namur (Belgium).
